FERPA Compliance Statement

EduNest is designed to operate under the School Official Exception defined in 34 CFR § 99.31(a)(1) of the Family Educational Rights and Privacy Act (FERPA). Under this provision, EduNest functions as an extension of CCSD — acting on the district's behalf with no independent authority over student education records.

MVP Status: During the current pilot phase, EduNest collects only administrator contact information (name, title, work email, school name). No student education records are accessed or processed until a DPA is signed.

COPPA Compliance Statement

EduNest is a parent-facing and school-administrator-facing platform. Children under 13 do not have direct access to or accounts on EduNest. The platform is purpose-built for adults — parents, guardians, teachers, and school administrators.

Design Principle: EduNest was architected from day one as a parent-and-administrator portal. Children are the subject of care within the platform — not its users. This architectural separation is fundamental, not cosmetic.

CIPA Compliance Statement

EduNest fully supports the Children's Internet Protection Act (CIPA) requirements for K-12 technology vendors. The platform serves an exclusively educational purpose and operates within a closed, school-verified network.

CIPA Compliance Commitments

Closed Network Design: EduNest operates as a walled garden. Messaging, content sharing, and communications are restricted to verified school-district participants — no open social features, no external links, no anonymous access.

Nevada NRS 388 Compliance

EduNest complies with Nevada Revised Statutes Chapter 388 governing the privacy and security of pupil records. We have built specific protections aligned with Nevada's student data privacy requirements, including explicit commitments for Clark County School District.

CCSD-Specific Commitment

Clark County School District: EduNest recognizes CCSD as Nevada's largest school district and a leader in ed-tech governance. We have prepared a CCSD-specific Data Processing Agreement that references NRS 388 obligations explicitly — including data retention schedules, breach protocols, and subprocessor controls. Available immediately upon request.

Data Processing Agreement (DPA)

EduNest provides a standard Data Processing Agreement aligned with FERPA, COPPA, CIPA, and Nevada NRS 388 requirements. A CCSD-specific version referencing district policies is available on request.

DPA Clause EduNest Commitment
Purpose Limitation Student data processed solely to provide contracted EduNest services to CCSD. No secondary uses.
Data Categories Only data necessary to deliver platform features: student identifiers (provided by district), family contact info (parent-entered), transportation/nutrition preferences.
Data Retention Retained for the duration of the active contract. Deleted within 30 days of contract termination. Certified deletion available.
Security Measures TLS 1.2+ in transit, AES-256-GCM at rest, role-based access controls, SOC 2 compliant infrastructure, annual penetration testing.
Breach Notification District notified within 72 hours of discovery of any security incident involving student data. Full incident report within 5 business days.
Subprocessors Limited list of subprocessors (hosting, email delivery) provided at signing. District notified of new subprocessors with 30-day opt-out window.
District Rights District retains ownership of all student data. Full data export available at any time in standard formats.
Audit Rights District may request annual compliance audit reports. EduNest will cooperate with district-initiated security assessments.
Governing Law Agreement governed by Nevada law. Disputes resolved in Clark County, Nevada jurisdiction.
